Like any other business there are good, poor and average fisheries. In many cases improvements can be carried out at modest cost. Commercial fisheries in particular are always looking to improve the facilities for their customers.
The quality of landscaping varies enormously from fishery to fishery and county to county. The landscaping of a fishery can have a considerable effect on its amenity and its capital value. The type of plant species, positioning and management can all contribute to how a fishery looks. Some fisheries adopt a manicured “golf course” effect whereas others, more commonly, adopt a conservation approach with minimal grass cutting and a more natural look.
The presence of Koi Herpes Virus (KHV) and Spring Viraemia of Carp (SVC) are two of the most serious fish diseases found in coarse fisheries throughout the country. Many fisheries are turning to breeding their own stock to try and avoid importing disease, as well as taking other measures. We are able to keep up with the latest management techniques and ideas for minimising the risk of disease which can be fatal to any fishery.
We are also able to advise on many aspects relating to the creation of a fishery. We have recently helped clients by:
- Preparing expert reports for a large fishery – reference planning enquiries
- Providing evidence and need for owners dwelling
- Reviewing the open market rent of a commercial day ticket fishery, and advising on long term strategy to maximise capital value
- Advising major minerals operator on land and water use strategy following mineral excavation, to maximise both income and capital values
- Advising a County Wildlife Trust on rental values of lakes with specific management conditions.
Expert witness testimony
Fenn Wright are regularly instructed to prepare expert reports, attend planning appeals and Court in relation to fisheries and associated leisure property.
Most frequently we are asked to act as an independent or joint expert in the valuation of property for matrimonial purposes. We have the largest database of comparable evidence for the value fisheries and other properties with water in the UK and are well placed to prepare these specialist valuations.
In 2012 Fenn Wright were instructed by Fish Legal to act on behalf of Derbyshire Angling Association in respect of a proposed hydro scheme on Sawley Weir on the River Trent. The case went to the County Court and the judge ruled in favour of Fish Legal and their client. Fenn Wright’s role was to assess the diminution in value in relation to the proposed hydroelectric scheme.
More recently we have acted on behalf of the owners of Wylands International Fishery in Sussex where expert reports were required to assist with planning appeals in relation to facility buildings and other associated planning issues.
